Japan's Antarctic whaling hunt ruled 'not scientific'

Japan's Antarctic whaling program has been ruled as not for scientific purposes. The International Court of Justice has ordered a temporary halt.

Monday's ruling by the ICJ was read out in The Hague by presiding judge Peter Tomka of Slovakia. The case was brought by Australia in 2010, arguing that Japan's whaling in the Southern Ocean was a commercial exercise disguised as scientific research.

"In light of the fact the JARPA II [research program] has been going on since 2005, and has involved the killing of about 3,600 minke whales, the scientific output to date appears limited," Tomka said.

"Japan shall revoke any existant authorization, permit or licence granted in relation to JARPA II and refrain from granting any further permits in pursuance to the program," said Tomka.

Australia and environmental groups say Japan's insistence that its program is scientific is a way to get around a moratorium on commercial whaling, imposed in 1986 by the International Whaling Commission. Norway and Iceland have rejected the moratorium and conduct commercial whaling programs.

In its application, Australia accused Japan of failing to "observe in good faith the zero catchment limit in relation to the killing of whales." Japan argued it was an attempt by Australia to use the court to impose its cultural standards on Japan, where the practice of eating whale meat is a culinary tradition, rather than a violation of international law.

Japan has said that its haul from the Southern Ocean has dropped to a record low because of "unforgivable sabotage" by activists from the group Sea Shepherd.

"... Question Two: What happens when you die?

This is so complicated, but I'm going to divide it into two parts, both spiritual. The death of a Human, which all of you in the room have experienced, is not the end. This is intuitive within you, because you've gone through it before. But the truth of it hides just under the surface. You're not really quite sure what will happen to you, but your intuition tells you it's not the end.

There is no sting in death. Not for you. But for the ones around you, there is. So the first thing I want to tell you about death is that those around you often suffer. Sometimes that is appropriate, for it brings them to their knees, especially when you leave too soon. Sometimes, because of that, they will discover what is inside of them, incredible spiritual solace, and then realize that your death was the catalyst for their enlightenment. Do you understand that process? Sometimes you are partners in this, with agreements in advance for potentials to help each other even through Human death. So it's not something to mourn at all. Often, it's the completion of a beautiful arrangement.

What happens when you die physically? That's easy - you return to the dust of the planet. What more do you want to know? Corporeal? Easy. That's just part of the Gaia process. But let me tell you about the moment of transition. You lose three ounces of something that no one knows about. The three ounces is quantum information. It's the quantum part of your spiritual core, everything that ever was of you, and it doesn't go up, it goes down. It goes back to the Cave of Creation and beyond.

We've told you this before. Part of it also goes to the Crystalline Grid. Some of it even goes to the cetaceans of the earth. There is a system here that allows Gaia to remember your life, and it's stored in the planet. Your spirit comes home, but not your Akashic Record. It stays on the planet because the planet owns it. You have changed the planet by what you've done, but you don't bring it home with you. When you come home, however, we have a party. I've told you that before. Oh, dear one, there's no sting in death. Not your own. You will know it right away, within three days. By then, you are "fully aware" that you're a piece of God. You remember. You hear the music again.

Then soon, you come back here (Earth), and when you do, it's sometimes faster than you've been told, for things are speeding up. Sometimes you come back born into your own family as grandchildren within your same karmic group. That's a process of the Lightworker so that your grandparents can teach you things that only they can teach you.

And when you take your first breath, you pick up something. You pick up all of the soul energy from the Cave of Creation and the Crystalline Grid that you stored there when you left. That is called Akashic inheritance. Artists become artists. Policemen become policemen. It's in your genes. It's in your DNA, who you used to be. Even the proclivities for the things you like and don't like - like food, choices - come in with you from the past Akashic inheritance.

Sometimes the question is asked, "Should I be a vegetarian? What is correct for my body spiritually?" I will tell you what is correct for your body spiritually - the thing that makes sense to you! If you've spent lifetimes in Tibet or India, you're probably craving different foods than that which is in the United States. That's how it works, dear ones. Your body reacts to what it remembers, and if that serves you by not eating meat, then that is what you should do for your health. Do not project it onto your friends, for they have their own Akashic health remembrance. They have their own system that works for them.

Humans love to compartmentalize everything and, therefore, when someone finds something good for them, they wish everybody to do it. Do not criticize others because they don't have your unique remembrance. This also applies to the belief systems of others. The ones who have found God or have found joy in a system that works for them is because they are tuned to it. Perhaps they were the very disciples of the masters! They're tuned to it and they want for everyone what works for them. Much of it has integrity, but it may not be for you.

What happens at death? It's a system - beauty, honor, and you become the piece of God that you know you are. When Elijah ascended, you got to see it through the eyes of Elisha. Elijah turned into a light so bright that Elisha couldn't even look at it. Then it split into parts. Elisha saw the Merkabah, the field around the Human, the chariot that Elijah rode in. He saw it and reported it. What do you think it was? The Human got to see ascension. That's death. ...."

The leading court at the UN will rule on Monday on whether Japan has the right to hunt whales in the Antarctic, an emotive case that activists say is make-or-break for the mammals' future.

Australia took Japan to the international court of justice (ICJ) in The Hague in 2010, accusing Tokyo of exploiting a loophole by hunting whales as scientific research to get around a 1986 ban on commercial whaling.

Australia has asked the ICJ to order Japan to stop its Jarpa II research programme and "revoke any authorisations, permits or licences" to hunt whales in the Southern Ocean.

During hearings last year, Canberra accused Tokyo of doing nothing more than "cloaking commercial whaling in a labcoat of science".

Norway and Iceland maintain commercial whaling programmes in spite of the 1986 International Whaling Commission (IWC) moratorium, but Japan insists its programme is scientific, while admitting that the resulting meat ends up on plates back at home.

Japan has killed more than 10,000 whales under the programme since 1988, according to Canberra, allegedly putting it in breach of international conventions and its obligation to preserve marine mammals and their environment.

In its application to the ICJ, Australia accused Japan of failing to "observe in good faith the zero catch limit in relation to the killing of whales".

Japanese officials declined to comment on specifics ahead of the ruling, but a fisheries agency official said it maintained the view that "Japan's whaling is purely for the purposes of obtaining scientific data, so that whale resources can be sustainably maintained".

Tokyo has consistently defended the practice of eating whalemeat as a culinary tradition. Its lawyers have said the Japanese have a "proud tradition of living in harmony with nature, and utilising living resources while respecting sustainability".

The country's fisheries minister, Yoshimasa Hayashi, vowed last year that Japan would never stop its "long tradition and culture" of whaling.

Japanese officials have said Tokyo will accept the verdict from the ICJ, set up after the second world war to rule in disputes between countries.

Australia also said it would respect the ruling, but added that its views were clear. "We oppose all commercial whaling, including Japan's so-called 'scientific' whaling."

In April last year, Japan announced its whaling haul from the Southern Ocean was at a record low because of "unforgivable sabotage" by activists from the Sea Shepherd environmental group.

Sea Shepherd has called the ICJ case make-or-break for whales in the Southern Ocean.

"We are still preparing to head down regardless [of the ICJ's decision]," said Jeff Hansen, the organisation's director. Sea Shepherd spends about £2.4m annually on its anti-whaling campaigns.

John Frizell of Greenpeace said a decision in favour of Australia "would place Japan in a very difficult position and present great difficulties for its operation in the Antarctic".

If the court rules in Japan's favour, however, "they will feel vindicated and free to continue their operations, which are becoming increasingly controversial", he said.

Sydney — Environmental activist group Sea Shepherd have returned to land after their longest-ever anti-whaling campaign in the Southern Ocean, claiming to have saved more than 750 whales in their annual high seas showdown with Japanese whalers.

Sea Shepherd's ships Bob Barker and Steve Irwin docked in Wellington and Hobart Saturday after 94 days at sea, formally ending the group's 10th annual harassment campaign of the Japanese harpoon fleet.

There were three high seas confrontations during the campaign, described by Sea Shepherd as "ambushes" from the Japanese, and Bob Barker captain Peter Hammarstedt claimed the season had been a success.

"Although the whale poachers have not yet released the number of whales they have killed this season, we are confident that they have not even reached one quarter of their bogus self-allocated quota, and estimate that our efforts have saved over 750 whales," he said.

The group did not offer any details to support their claim and Japan's fisheries agency was not immediately available for comment.

Sea Shepherd said this year's campaign, which began on January 5, had been its longest ever in the Southern Ocean.

"These whale poachers, heavily funded and backed by the government of Japan, have thrown absolutely everything at us and we have come out on top," said Jeff Hansen, director of Sea Shepherd Australia.

During the season the conservation group said the Japanese had twice been exposed butchering minke whales poached from the Southern Ocean Whale Sanctuary.

Japan catches the animals there under a "scientific research" loophole being challenged by Australia in the International Court of Justice, with a ruling due this year.

Steve Irwin captain Sid Chakravarty said the harpooners had used "aggressive" tactics to flee from the activists but "they could not hide from us".

Sea Shepherd estimates that it has saved 4,500 whales from slaughter in nine previous Southern Ocean campaigns.

Washington — On a cold March night 25 years ago, the supertanker Exxon Valdez struck a reef off the coast of Alaska, spilling 11 million gallons of crude oil into the sea.

Images of oil-soaked birds and fouled beaches horrified the United States, leading to tighter regulation and greater environmental consciousness.

The Exxon Valdez grounding on March 24, 1989, has since been replaced by the 2010 Deepwater Horizon disaster in the Gulf of Mexico as the worst oil spill in US history.

Yet local communities in the formerly pristine Prince William Sound are suffering.

"There is a lot of bitterness still to this day," Steve Rothchild from the Prince William Sound Regional Citizens' Advisory Council told AFP.

The council was created after the spill to oversee oil transportation and provide a voice for the communities that were struggling after the collapse of the fishing industry.

Rothchild complains that Exxon did not fulfill its promise to "make the people whole."

"When the court case was finally adjudicated, the people got pennies on the dollar they really deserved," he said, using an expression meaning they were short-changed.

Dwindling salmon population

The oil giant, which changed its name to ExxonMobil after a merger in 1999, was originally ordered to pay $5 billion to more than 32,000 Alaska Natives, landowners and commercial fishermen.

After a lengthy legal battle, the Supreme Court limited the punitive damages in June 2008 to about $500 million.

Exxon also spent more than $2 billion on the cleanup effort and reached a settlement with the US government that included $900 million in payments, a $25 million criminal fine and $100 million in restitution.

Angela Day's husband was a fisherman in the small port town of Cordova before the dwindling salmon and herring populations forced him out of business.

"He's been fishing there for about 30 years, he grew up in the fishing industry and had two vessels at the time of the oil spill," Day said.

"It was really hard on the community," she recalled, adding that the disruption of the local economy led to "more drinking, some suicides, more divorces."

Exxon hired some fishermen to help the cleanup effort but many lost their livelihoods as the value of their boats and fishing permits plummeted.

"My husband did not even get back a quarter of what his two fishing vessels were worth at the time," said Day, author of the recently published account "Red Light to Starboard: Recalling the Exxon Valdez Disaster."

'Got people thinking'

During that fateful March night in 1989, the captain Joseph Hazelwood diverted the Exxon Valdez from the normal course to avoid icebergs before he left the bridge.

With an unlicensed and possibly overworked third mate in charge, the 986-foot (300-meter) tanker failed to return to the shipping lanes and ran aground.

Witnesses saw Hazelwood drinking vodka in a local bar before the departure and a blood test showed alcohol several hours after the accident, but a jury found him not guilty on the charge of operating a vessel while under the influence of alcohol.

The toxic crude polluted 1,300 miles (2,000 kilometers) of shoreline and took the lives of an estimated 250,000 seabirds, 2,800 sea otters, 300 harbor seals and as many as 22 killer whales. The cleanup efforts went on for four summers.

"There was a sea change in environmental consciousness," Day said.

"The disaster got people thinking about how we are getting our energy."

New legislation required that all tankers transporting oil through Prince William Sound must have double hulls and be escorted by two tugboats. Contingency planning was ramped up.

But even a quarter century later, remnants of the spill linger on the shores of southern Alaska.

A recent study found hidden pockets of oil on remote rocky beaches.

"We have learned that certain kinds of beaches with boulder are hard to clean up," said lead researcher Gail Irvine from the US Geological Survey, stressing that the mousse-like oil can "persist for decades" once it is in sheltered positions.

'Cleanup artist'

A report by the Exxon Valdez Oil Spill Trustee Council identified in 2010 approximately 50 beach segments with lingering oil, representing a total shoreline length of about 1.5 miles.

"You can dig a hole a foot down and find liquid oil," Jeep Rice, a retired longtime researcher with the National Oceanic and Atmospheric Administration (NOAA), told AFP.

"The oil that's below the surface declines very slowly. It's probably gonna be there for another 50 years."

At least most species have recovered from the environmental disaster.

"Prince William Sound is a functioning ecosystem. The water is clean," Rothchild said.

"Nature is a wonderful thing, nature is its own cleanup artist."

CNOOC makes gas discovery in South China Sea

China National Offshore Oil Company (CNOOC) announced Wednesday it recently made a new mid-sized gas discovery called Lingshui17-2.

It is the company's first deepwater exploration breakthrough in Qiongdongnan Basin in the South China Sea.

Lingshui17-2 is in east Lingshui Sag in the deepwater area of the basin, with an average water depth of about 1,450 meters.

The discovery well was drilled and completed at a depth of 3,510 meters and encountered the gas reservoir with a total thickness of about 55 meters.

The discovery has not only proven the exploration potential of Lingshui Sag, but also further confirmed good exploration prospects in the deepwater area of Qiongdongnan Basin, said the CNOOC.

Listed in Hong Kong and New York, the CNOOC is the largest offshore oil and gas producer in China.

WWF Inks Deal With Maluku Islet to Protect Waters

Jakarta. The World Wide Fund for Nature announced the signing of a marine conservation agreement with the indigenous community of Seram Island in Maluku to protect the fisheries potential in the area.

Abdullah Habibi, capture fisheries coordinator at WWF Indonesia, said the Kataloka community was chosen because of the tremendous fisheries potential in the waters where it lived. The area consists of four small islets — Nukus, Koon, Gorom and Grogos — and is rich with a wide variety of fish, though the conservation would be focused around Koon.

“Koon has been long known as a spawning spot for some grouper species,” Abdullah said.

The agreement between WWF and the local community is aimed at conserving the marine potential in the area.

Abdullah said the area was chosen as a conservation area because the Kataloka’s local wisdom was strong, and with a strong community sprint the conservation would be easily implemented.

Community leader M. Syaiful Akbar Humarei said that by declaring Koon as a conservation area it was expected that environmental destruction would decline.

“The destruction that happens to our sea is mostly caused by our own people. Some continue to use fish bombs and if we don’t stop then the island and the ecosystem will be destroyed,” he said.

By declaring Koon as a conservation area, local fishermen will no longer be allowed to take any fish or coral from the area. Locals who violate the rule could be ordered to pay up to Rp 5 million ($440) in fines. If the violators are from outside community they could be fined a maximum of Rp 15 million.

Some locals have been appointed as patrol officers to prevent people from violating the fishing prohibition in Koon that applies to more than two hectares.

Despite the prohibition, some locals said they would not comply with the new regulation and would carry on fishing in the area.

Odi Anzar, who lives on Grogos, said he had often caught fish in the conservation area and had never been punished.

“I still catch fish. I was arrested once and was given a warning, but I keep coming back to catch fish,” he said.

WWF has warned Indonesia to pay special attention to the maritime and fisheries sectors, which are facing the threat of natural resources overexploitation.

The increasing damage to the maritime sector has prompted President Susilo Bambang Yudhoyono to set up a target to have 20 million hectares of sea dedicated as conservation areas by 2020.

Currently Indonesia has 15.39 million hectares of marine conservation area.

Missing MH370 likely to have disintegrated mid-flight: experts

The disappearance of Malaysia Airlines Flight 370, which lost contact with aviation authorities en route to Beijing from Kuala Lumpur at 1:20am on Saturday morning, is most likely due to a sudden breakup of the plane mid-flight, according to Chinese experts.

An air search and rescue mission continues in the South China Sea where the Boeing 777 — carrying 239 passengers, including 154 Chinese nationals and one Taiwanese national — is likely to have crashed. The team is on a race against time to search for the plane's black box, which records flight data and cockpit voice transmissions, though at the time of writing the box's signals have yet to be detected.

On Sunday morning, Hugh Dunleavy, commercial director at Malaysia Airlines, suggested the reason why the black box — which can ordinarily radiate signals for 200km-300km — has not yet been found may be due to the seriousness of the plane's disintegration.

Song Wenbin, an aviation expert at the Shanghai Jiao Tong University, told Chinese-language Beijing Times that it is unlikely that the disappearance of flight MH370 was caused by weather. The plane lost contact around 40 minutes after departure, which means it would have likely exceeded an altitude of 10,000 meters, where influences of the weather become minimal, Song said.

Ma Wei, a lecturer at the same university, said it is unusual for a plane's signal to be completely severed. Even if flight MH370 experienced an engine problem that affected its communication system, there are sufficient backups in place to keep the system up and running, Wei said. It is also improbable that the communication system was shut down manually as a plane has more than a single communication system and has other ways of notifying air traffic control, he added.

A hijacking has been considered another possibility, though Chinese air force test pilot Xu Yongling said it is unlikely for this to have occurred without anyone on board making contact with the land before the plane crashed. Cockpits of modern commercial flights have excellent safety features, Xu said, adding that pilots can activate the SOS system without leaving their seats.

Zhou Jisheng, an aircraft designer at Guangdong Changsheng Aircraft Design Co, told the Beijing Times that the most likely possiblity is that the plane experienced a sudden breakup which did not allow the plane's crew sufficient time to notify aviation authorities.

Song concurs with Zhou's assessment but said that if this were the case, the debris would be scattered across a large area and should have been easily spotted by rescue teams. Given that the plane has not yet been spotted, it is also possible that the entire plane, or at least most of it, crashed into the sea at the same time, he said.

Zhou said there are two possibilities if the plane did disintegrate mid-air. The first is some kind of catastrophic structural failure stemming from corrosion and wear and tear over time or the plane's pressurization and depressurization system. The other is an explosion caused by a bomb or similar device.

The Beijing-based Economic Observer reported, citing aviation experts, that the probability that flight MH370 was brought down by a terrorist attack or bomb is higher than that of mechanical failure. If there was some kind of mechanical failure which caused the plane to drop from the sky, it would still take at least six to seven minutes, providing crew plenty of time to make contact with ground control, the paper said.

....SB: That’s very good, Lord. Thank you. I’m going to move quickly to Flight 370, and then hopefully a short talk on global citizenry.

Ashira said that Flight 370 had exploded, but he didn’t say what the cause of the explosion was. Others have said that a secret naval weapon was used to cause it to disintegrate. And recently a prominent channel said the plane was suffering from hydraulic failure, was in an uncontrolled state, at risk of imminent destruction; whisked out of the air in mid-flight, was taken aboard an enormous spaceship from Sirius claimed to be part of the Federation fleet under the Ashtar Command whose full report is available from a certain website.

Now, Ashira said they took a few people up who still wanted to remain in form, but the rest — they passed on. What is the truth, Lord?

AAM: This is not an action — let us put it this way — this is not an action that your star brothers and sisters have been deeply involved in. This is an action of what we would refer to, or Gabrielle would refer to, as of violence, of sabotage, of subterfuge. And it has continued.

So there are lies upon lies upon lies. And what is occurring … this is a terrible situation. And it is painful to so many. But what it is also doing for humanity, it is bringing up what we would call shared compassion and grief. Because if you were to look at the grief and the confusion and the compassion component of what is being felt and emanating from the hearts of the collective, individuals all over the planet, it is out of alignment with the situation even including those who have been on the plane and who have suffered and the families that are left suffering the loss of their loved ones.

So it has amplified and shown the global community, in a time when there has been much strife and conflict on the ground, the other side of the scale, where you are seeing the global community coming together in compassion and sending healing for many. It is also bringing together the global community in saying, “We require, we demand truth.” Because there have been such significant untruths, every step of the way. And now what is occurring, among what you think are responsible agencies of many countries, is that they are looking for scapegoats. They are looking for situations to hang this on.

The truth will come out, but the function of this act of violence has been hijacked in many ways not by your star brothers and sisters but by the Company of Heaven to teach several very important, critical, timely lessons. The ship has not been taken on board a mothership elsewhere. That is false hope.

SB: Where is the ship, Lord? Is it blown to smithereens, or is it at the bottom of the ocean?

AAM: For all intents and purposes, it is not intact. We cannot give you the totality because that would be breaking our agreement.

SB: And then of course you couldn’t tell us what nation did it, either?

AAM: It is not so much a nation as individuals acting independently.

SB: All right. I’m not sure whether I should go further in trying to get more details, or…. whether….

AAM: Please do not.....

On Heavenly Blessings today, Suzi Maresca asked Ashira, Commander of the Neptune, what caused the loss of Malaysian Airlines Flight 370 and Ashira replied:

 “It was not interdimensional slippage and they were not taken by us. So let us be very clear. We would not do that. Not at this point because from our perspective that would be seen as an act of war or an act of terrorism. We would not break that many hearts.

“So what happened was that there was an explosion and the ship went down. Could we have saved it? There are certain things that we are not permitted to interfere with. But let us also …. now this is what we can say … on that ship [everyone?] was taken care of. …

“There were many upon that ship who as a collective had agreed to leave together … and this is something that often happens … there is a group soul, whether you believe it or not. Now those who did not want to pass from their form were beamed up.”
